Membership Service

• Upon completing and confirming the membership application, OWNDAYS Hong Kong will provide services to members based on the services, items, content, status and functions established by the system at that time; OWNDAYS Hong Kong reserves the right to add, reduce or change the services and items at any time , all or part of the content and function rights without individual notice.
• Some services, items, content or functions may be built or provided by OWNDAYS Hong Kong partners, or require individual application or login procedures by members, or need to be paid for by members. Members shall follow the instructions and related agreements of each service, item, content or function modified at that time.
• OWNDAYS Hong Kong reserves the right to change the terms of use, individual terms of use for each service or item, change free services to paid services, and change the standard charges at any time. The changed content will not be published individually except on the service webpages. If the member continues to use the service after the previous modification or change, it is deemed that we have your consent, understood and agreed to accept the modification or change. The relevant activities performed by the member, including the continued use of the service, will be subject to the modified or changed terms of use. If you cannot comply with the content of these terms of service, individual terms of use of each service or project, or do not agree with the content of these terms of service, please stop using the membership services provided by OWNDAYS Hong Kong immediately.
• Other terms may be applicable to some of the member services, and members shall follow the terms of each service or item at the same time. The validity of such terms shall apply in prority.
• For user under the age of 18, they should ask the parent or guardian to read these terms of service and obtain their consent before joining the membership before they register and use the membership services provided by OWNDAYS Hong Kong.

Account and password registration and security issue

• The member shall complete the registration process, provide the data required, login or transaction process, and shall ensure that all the information provided is correct and updated. If the information provided by the member is changed afterwards, the member shall immediately update the retained data. If the member cannot provide the data insstatly, does not provide the data in the specified way, or the data provided is incorrect or inconsistent in a result cannot login or use the membership service, OWNDAYS Hong Kong reserves the right to refuse or suspend the membersip at any time without prior notice and the right to provide all or part of related member services.
• Members can choose their own member ID and password, but for the member ID and password, the member has the obligation to keep it properly and keep it confidential, and shall not disclose or provide it to a third person. For the behavior of using a specific member ID and password to use the membership services, and all actions after logging in to the system shall be responsible to the member whp the member ID and password belong to.
• If a member is found or suspected that his/her member ID and password have been used fraudulently or improperly by a third person, the member should inform OWNDAYS Hong Kong Customer Service Center immediately, OWNDAYS Hong Kong will take appropriate action in time. However, the mentioned action shall not be interpreted as OWNDAYS Hong Kong and its membership service providers shall bear any form of compensation or obligations to members in any ways.

Protection of personal data

• OWNDAYS Hong Kong protects the personal data of each member. Regarding the personal data provided by the member, except that the member may be involved in violation of law, infringement, violation of the terms of use, or with the member’s consent, OWNDAYS Hong Kong will not provide member’s personal data to third parties.
• Some membership services are operated or provided by OWNDAYS Hong Kong partners. In order to provide such services to members, it may be necessary to provide members’ personal data to these partners. If the member is not willing to disclose personal data to these partners, member can choose not to use the specific service, but if the member chooses to use the specific service, OWNDAYS Hong Kong will disclose the personal data of the members to the partners of these specific services after informing the members on the relevant page.
• Under the following circumstances, OWNDAYS Hong Kong may view or provide members’ personal data or related communication data to relevant government offices, or a third party who claims that his/her rights have been infringed with appropriate evidence.
  • According to the laws and ordinances , or with the justic orders or other relevant government offices;
  • The member is involved in violating laws or ordinances , infringing on the rights of third parties, or violating these terms of use or the use specifications or agreements;
  • Provided to the insurer to assist in handling insurance incidents;
  • To protect the security of the membership service system or the legitimate rights and interests of the operators;
  • To protect the legal rights and interests of other members or other third parties;
  • To maintain the normal operation of the system.
• The member agrees and understands that the relevant data provided or collected automatically by the server when the member registers or uses the membership service, OWNDAYS Hong Kong will collect, process and use, including cross-border transfer and storage, in accordance with the "Personal Data Protection" and "OWNDAYS Hong Kong Customer Privacy Policy". Regarding OWNDAYS Hong Kong’s privacy protection and related statements, members can browse the "OWNDAYS Hong Kong Privacy Policy" page at any time.

Provision and use of membership services

• All relevant domain names and IP addresses provided by OWNDAYS Hong Kong membership service providers or partners to provide membership services or specific services, it’s owned by OWNDAYS Hong Kong or the service providers or other legal rights holders of OWNDAYS Hong Kong,
• Services or functions of searching, retrieving, finding products or photos provided in membership service, it’s automated service and software tools provided by the system, it depends the member’s selection and conditions or content.Therefore, the search of product or image results, relevant links and content obtained are all provided by website or related third party, and shall be responsible by the provided website or related third party.
• For specific membership service, OWNDAYS Hong Kong may contact partners or other vendors to provide relevant files, photos or other works or information, or member’s browsing, searching and usage, however, members need to comply with relevant authorization agreements or restrictions. The legal rights of such files, photos or other works or information is responsible by our partners or vendors who provide the files, photos or other works or information.
• All advertising information that appears in the membership service includes but not limited to text, pictures, animation, sound or video, all are published by OWNDAYS Hong Kong in accordance with the commission of advertisers, advertising agencies or sponsors, OWNDAYS Hong Kong respects the rights of advertisers, advertising agencies and sponsors and may not censor the content of advertisements in advance. Members shall judge the accuracy and credibility of the advertisement by themselves, and the advertiser, advertising agency or sponsor shall be responsible to the member for the content of the advertisement.
• Information, advertisements or content suggestions obtained by members by using OWNDAYS Hong Kong membership services or links to other websites through each membership service include but not limited to business, investment and financial management, medical, legal and other information, OWNDAYS Hong Kong does not guarantee its completeness and accuracy, and the operators of such websites shall be responsible for the information, advertisements or content suggestions on the websites in accordance with their service usage specifications.

Data Security

• Members should back up all the data uploaded, published or stored in membership service system by themselves. OWNDAYS Hong Kong or each membership service provider will regularly back up the data stored by the member according to the method and processing backend by the membership service system at that time, but there is no guarantee that all the data stored by the member will be fully backed up. Members shall agree that OWNDAYS Hong Kong and the service providers are not responsible for unbacked up, deleted data, or failed backup storage for each member.
• The OWNDAYS Hong Kong membership service system does not guarantee that the information uploaded by the member will be displayed normally, nor the acuracy of the data transmission; if a member finds an error or omission in the system, please inform OWNDAYS Hong Kong or the management of membership service system immediately.

Members’ obligations and commitments and must not engage in the following behaviors

• Members are not allowed to engage in any commercial solicitation or post advertisements without prior authorization in the membership services of OWNDAYS Hong Kong.
• Members must follow the obligations and commitments and must not engage in the following behaviors
  • Send out any emails, file or data that abide by relevant laws and regulations in Hong Kong.
  • Publish, transfer, send or save any text, photo, video or file in any form which is defamatory, insulting, pornography, gambling, discriminatory, threatening, offensive, indecent, obscene, false, violation of public order or good customs or otherwise illegal.
  • Publish, transmit, send or save any works or data that infringe on the intellectual property rights or other rights of others.
  • Publish, transmit, send or save any content that violates the provisions of children and adolescent welfare and protection law that is harmful to the physical and mental health of children and adolescents
  • Publish, transmit, send or save any title, subtitle, or any content that may cause other members or third parties to mislead OWNDAYS Hong Kong or membership service provider’s announcement.
  • Collect email addresses, contact numbers and other personal data of others without consent;
  • Extract or use all or part of the contents of any database in the membership service without permission.
  • Extract or use all or part of any product graphics and database on the OWNDAYS Hong Kong website without permission;
  • Publish, transmit, send, save viruses, or any other programs or messages that can damage or interfere the computer systems or data;
  • Action that disrupt or interfere the operation of the membership service system or violate general Internet etiquette
  • Unauthorized access to the OWNDAYS Hong Kong membership service system or the network related to the system, or using another person’s member account fraudulently or forging the sender’s identification data to send email in an attempt to mislead the recipient’s judgment
  • Any behavior that hinders or interferes other users to use the membership service
  • Send out chain letters, spam, advertising letters or other purposeless emails or messages;
  • Any act of stealing, changing, or destroying member accounts, passwords or access rights of various membership service through illegal channels;
  • Other behaviors that do not meet the purpose of use provided by this service or behaviors that OWNDAYS Hong Kong has legitimate reasons to consider inappropriate
• If a member or a third person uploads, publishes, transmits, sends or saves any text, picture, video, file or other works or materials without authorization in violation of the previous regulations, OWNDAYS Hong Kong and each membership service provider have the right to delete, move or stop access at any time without prior notice. In addition to the legal liabilities arising therefrom, OWNDAYS Hong Kong and its membership service providers shall be liable for compensation and repayment for the damages and expenses incurred.

Protection of intellectual property

• All webpage designs, interfaces, URLs, trademarks or logos, computer programs, databases, etc. provided by the membership service, as well as trademarks, copyrights, other intellectual property rights, and data ownership, belong to OWNDAYS Hong Kong or the provider of each membership service or owned by the legal right holder who authorizes OWNDAYS Hong Kong and the service providers.
• The various membership service provided by OWNDAYS Hong Kong only provide relevant server space and systems for members to use, hence, members are not authorized by OWNDAYS Hong Kong and the membership service providers and the relevant trademarks, copyrights or other intellectual property rights of individual membership service.
• If a member finds that other users have infringed their intellectual property rights by using membership service, please provide the reasons, infringement content, and attach relevant evidence or rights declaration documents, and then contact us my written mail or claim their rights to OWNDAYS Hong Kong

Disclaimer

• The various membership service provided by OWNDAYS Hong Kong and various membership service providers are only available in accordance with the functions and current conditions of the respective services at that time, specific requirements or needs for users, including but not limited to speed, safety, reliability, completeness, accuracy, and no disconnection or error, etc, OWNDAYS Hong Kong and the membership service providers shall not bear any responsibility.
• OWNDAYS Hong Kong and the membership service providers cannot guarantee 100% security of Internet data transmission, and we cannot fully guarantee the security of files or data sent or received by members. Except for those caused by our intentional or gross negligence, we will not be liable for any damages caused by the error or defect in our system or the failure, loss or error in the transmission or storage of mails, files or data.
• Any direct or indirect damage caused by the use of the membership service provided by OWNDAYS Hong Kong or membership service providers, OWNDAYS Hong Kong and each member service provider shall not be liable for any compensation, even if the OWNDAYS Hong Kong and each member service provider’s recommendations have clearly reminded.
• Members who do not use the services through OWNDAYS Hong Kong and other membership service platforms, conduct transactions or services with any third person or use any of OWNDAYS Hong Kong’s membership service without authorization, their rights will not be protected by neither OWNDAYS Hong Kong nor any other membership service provider. If this causes any loss to the member, the member shall bear all the responsibilities. OWNDAYS Hong Kong and the membership service providers shall not be responsible or compensate the member for the loss. Anyone who engages in the above-mentioned breach of contract is therefore subject to investigation by the competent authority of the target business, or causes litigation disputes, the perpetrator shall bear all legal responsibilities.
• OWNDAYS Hong Kong and membership service providers may, in accordance with the law, retain the information of the defaulting member in the OWNDAYS Hong Kong membership service platform, including but not limited to personal data, communication content, content published, transaction information, etc., to provide or disclose to judicial authorities and courts with the right to access in order to provide reasonable and necessary assistance.

Website service suspension or interruption

• Member services are suspended or interrupted due to the regular maintenance, reconfiguration or change of the system for the function of membership service platform. OWNDAYS Hong Kong or membership service providers will use the official website or official Facebook, announcement or other appropriate method to annouce.
• Under the following circumstances, OWNDAYS Hong Kong and its membership service providers will suspend or interrupt all or part of the membership service, and will not be liable for all direct or indirect damages suffered by the members :
  • Relocation, replacement, upgrade, maintenance or repair of software and hardware equipment related to member services;
  • The member has any violation of laws and regulations, these terms of use, or the usage specifications and agreements of the membership service platform.
  • The membership service is suspended or interrupted due to the actions of a third party, natural disasters or other force majeure.
  • Membership service are suspended or interrupted due to other reasons that are not OWNDAYS Hong Kong or membership service providers fully controlled or are not attributable to OWNDAYS Hong Kong or membership service providers.
• If a member breaches these terms of use, specifications or agreement of membership service platform, OWNDAYS Hong kong and the membership service providers reserve the right to temporarily suspend or terminate the services at any time, and will not be liable for any compensation or compensation to member.

Change of Terms of Use

• OWNDAYS Hong Kong reserves the right to modify the terms of use of this membership service and the specifications or agreements of membership service platform at any time. The modified content will be published on the relevant webpages of each membership service platform, and members will not be notified individually.
• The illegality, invalidity or unenforceability of any provisions of these Terms of Use under the law of any jurisdiction shall not affect its legality, validity or enforceability under the laws of any other jurisdiction nor the legality, validity or enforceability of any other provision.

Termination of Service

Based on the company operation, OWNDAYS Hong Kong may make a change or addition to or terminate all or part of the membership service, except for the pro rata refund of paid services that have been collected but not used, OWNDAYS Hong Kong will not be held liable for any detriment or damage incurred by the members as a result of any of the preceding actions.

Jurisdiction

Any interpretation and application of the membership service shall be governed by the laws of Hong Kong Special Administrative Region (HKSAR).
